O banco pediu desculpas e disse que um computador havia cometido um erro ao gerar a cobran\u00e7a.<\/p>\n<p align=\"justify\">Seria um caso cl\u00e1ssico de \u201cignore o aviso em caso de quita\u00e7\u00e3o\u201d, mas o casal ainda recebeu uma segunda notifica\u00e7\u00e3o. Quando receberam a terceira, os Vivians acharam que j\u00e1 era demais e processaram o banco. Como o banco insistia em culpar o computador, o juiz A. Jay Cristol decidiu punir a m\u00e1quina. Segundo a senten\u00e7a, fica<\/p>\n<blockquote>\n<p align=\"justify\"><span style=\"font-family: Georgia\">ORDENADO que o computador do NationsBank, envolvido em desobedi\u00eancia civil, seja multado em 50 megabytes de mem\u00f3ria de disco r\u00edgido e 10 megabytes de mem\u00f3ria de acesso aleat\u00f3rio [RAM]. O computador pode se livrar dessa condena\u00e7\u00e3o se cessar a produ\u00e7\u00e3o e envio de documentos para Mr. e Mrs. Vivian.<\/span><\/p>\n<\/blockquote>\n<p align=\"justify\">Se n\u00e3o for resultado de ignor\u00e2ncia inform\u00e1tica, ainda comum nos meios judici\u00e1rios, a senten\u00e7a \u00e9 no m\u00ednimo uma <em>trollagem<\/em> genial: o juiz lava as m\u00e3os e obriga sutilmente que o banco \u2013 em \u00faltima an\u00e1lise respons\u00e1vel pela programa\u00e7\u00e3o do computador \u2013\u00a0 d\u00ea um fim no <em>spam<\/em>.<\/p>\n<p align=\"justify\">\u00c9 dif\u00edcil dizer se a senten\u00e7a foi cumprida ou mesmo se \u00e9 tecnicamente vi\u00e1vel. Por exemplo, quem aplicaria a &#8220;multa&#8221; sobre o c\u00e9rebro eletr\u00f4nico? O banco? Um t\u00e9cnico do Estado? Um agente policial? Mr. Cristol parece acreditar que um computador seria uma entidade consciente e se sentiria amea\u00e7ado com uma limita\u00e7\u00e3o de mem\u00f3ria (que nos parece pequena hoje, mas era consider\u00e1vel na \u00e9poca). No fim das contas, o mais prov\u00e1vel \u00e9 que o banco (ou o computador) tenha recorrido da senten\u00e7a.<\/p>\n<p align=\"justify\">Punido ou n\u00e3o, o caso do computador do NationsBanks ainda d\u00e1 o que pensar: se um computador for capaz de cometer um crime de forma aut\u00f4noma, como ele seria punido? Destrui\u00e7\u00e3o f\u00edsica ou mudan\u00e7a de <em>software<\/em>? Ali\u00e1s, faria sentido punir uma m\u00e1quina? Em \u00faltima an\u00e1lise, um computador, mesmo que se torne aut\u00f4nomo, \u00e9 uma cria\u00e7\u00e3o humana. Seus criadores ou programadores deveriam ser, no m\u00ednimo, considerados coniventes.
