Em um desses casos, a \u00fanica evid\u00eancia contra o m\u00e9dico era o testemunho da pr\u00f3pria mulher que abortara, Jacquelin Harris. S\u00f3 que, de acordo com diferentes leis de Ohio, (1) a gestante que recorre ao aborto era c\u00famplice do crime e (2) o testemunho de um c\u00famplice era considerado insuficiente para uma condena\u00e7\u00e3o. Isso significa que:<\/p>\n<ul>\n<li>\n<div align=\"justify\">A acusa\u00e7\u00e3o pode argumentar que, se o doutor \u00e9 culpado, ele deveria ser condenado e que se ele \u00e9 inocente, a mulher n\u00e3o \u00e9 c\u00famplice e seu testemunho \u00e9 suficiente para conden\u00e1-lo. Em todo caso, ele deveria ser condenado.<\/div>\n<\/li>\n<li>\n<div align=\"justify\">A defesa pode argumentar que, se o doutor \u00e9 inocente, ele deveria ser absolvido. Se ele \u00e9 culpado, a mulher <em>\u00e9 <\/em>sua c\u00famplice, o que torna seu testemunho inv\u00e1lido para a condena\u00e7\u00e3o. Em todo caso, ele deveria ser absolvido.<\/div>\n<\/li>\n<\/ul>\n<p align=\"justify\">\u201cIsso p\u00f5e o j\u00fari em uma posi\u00e7\u00e3o de veredito auto-anulante\u201d, observa Peter Suber em <em>The Paradox of Self-Amendment<\/em> [<em>O Paradoxo da Auto-Emenda<\/em>]. \u201cSe eles consideram Jones culpado, devem concluir que Harris foi sua c\u00famplice, o que torna sua evid\u00eancia contra Jones insuficiente, ent\u00e3o devem absolver Jones. Mas se eles consideram Jones inocente, eles devem (ou pelo menos podem) considerar a evid\u00eancia de Harris legalmente suficiente, ent\u00e3o devem (ou pelo menos podem) condenar Jones\u201d.<\/p>\n<p align=\"justify\">N\u00e3o \u00e9 poss\u00edvel haver um empate. Ent\u00e3o qual foi o resultado? Curiosamente, Jones foi condenado. Como era o acusado foi considerado presumidamente inocente. Consequentemente, Mrs. Harris n\u00e3o foi, presimidamente, uma c\u00famplice. \u201cIsso levou \u00e0 not\u00e1vel situa\u00e7\u00e3o na qual o testmunho era admiss\u00edvel e poderia levar \u00e0 condena\u00e7\u00e3o\u201d \u2014 comenta Michael Clark em <em>Paradoxes from A to Z<\/em> [<em>Paradoxos de A a Z<\/em>] \u2014 \u201capesar do fato de que a condena\u00e7\u00e3o tenha minado o valor probativo do testemunho.\u201d<\/p>\n<p align=\"justify\"><strong>Refer\u00eancia Legal<\/strong><em>: State v.
