Em 1985, Oreste Lodi, ent\u00e3o com 61 anos, encontrou uma nova maneira de levantar seus pr\u00f3prios fundos (financeiramente falando): ele entrou com um processo contra si mesmo. No processo aberto na Corte Superior de Shasta County, Calif\u00f3rnia, Lodi apontou-se como parte acionada e como parte acionante. Como o acionado n\u00e3o respondeu \u00e0 den\u00fancia, houve um julgamento incomum: Lodi v. Lodi.<\/i> O caso foi resumido da seguinte forma (em ingl\u00eas):<\/div>\n

In a complaint styled \u201cAction to Quiet Title Equity,\u201d plaintiff named himself as defendant. The pleading alleged that defendant was the beneficiary of a charitable trust, the estate of which would revert to plaintiff, as “reversioner,” on notice. <\/p>\n

Plaintiff attached as exhibit A to his complaint a copy of his birth certificate, which he asserted was the \u201ccertificate of power of appointment and conveyance\u201d transferring reversioner’s estate to the charitable trust. Plaintiff went on to allege that for 61 years (since plaintiff\/defendant was born), defendant has controlled the estate, that plaintiff has notified defendant of the termination of the trust, and requested an order that plaintiff was absolutely entitled to possession of the estate, and terminating all claims against the estate by any and all persons “claiming” under defendant.<\/p>\n

When defendant\/beneficiary failed to answer, plaintiff\/reversioner had a clerk’s default entered and thereafter requested entry of a default judgment. At the hearing on the entry of a default judgment, the trial court denied the request to enter judgment and dismissed the complaint.

Em portugu\u00eas claro: o Sr. Oreste Lodi alegou que, ao nascer, todos os seus bens teriam sido transferidos para um fundo de caridade que teria dura\u00e7\u00e3o de 61 anos e seria administrado por ningu\u00e9m menos que Oreste Lodi. <\/div>\n

O que o espertalh\u00e3o decidiu fazer foi executar judicialmente o tutor dos seus bens (ele-mesmo), pedindo a devolu\u00e7\u00e3o de suas propriedades. Mais tarde, estudiosos de Direito notaram que o caso \u00e9 absurdo n\u00e3o por uma quest\u00e3o de l\u00f3gica simples, mas porque:  a)<\/b> o documento apresentado (a certid\u00e3o de nascimento) n\u00e3o tinha qualquer valor jur\u00eddico no caso de uma cobran\u00e7a judicial de uma d\u00edvida; e b)<\/b> mesmo que a certid\u00e3o tivesse alguma import\u00e2ncia no caso, Lodi n\u00e3o apenas anulava  um fundo de caridade, (na verdade inexistente) mas tamb\u00e9m pedia, implicitamente, a anula\u00e7\u00e3o de seu nascimento!<\/div>\n

Quando a corte local desistiu do caso, Lodi ainda recorreu ao Terceiro Distrito de Apela\u00e7\u00f5es, preenchendo fichas como ambas as partes do processo. Infelizmente, a corte de apela\u00e7\u00f5es considerou o caso Lodi \u201cuma den\u00fancia fr\u00edvola e b\u00eabada\u201d.<\/div>\n

EPIC WIN ou EPIC FAIL?<\/b><\/div>\n
Depois, o Lodi-r\u00e9u passou a exigir que apenas o Lodi-requerente pagasse as custas do processo. Embora tenha considerado o caso todo como absurdo, o tribunal foi bem espertinho ao determinar o que fazer com os custos do processo:<\/div>\n

N\u00f3s consideramos que o requerente\/r\u00e9u\/benefici\u00e1rio deveria receber as custas de seu processo para que possa se recupar de si mesmo. No entanto, n\u00f3s acreditamos que a igualdade seria melhor servida requerendo que cada parte custeie seus pr\u00f3prios custos do processo.<\/span><\/div>\n<\/blockquote>\n
Ou seja: o tribunal n\u00e3o reconheceu a diferen\u00e7a entre as partes para julgar a a\u00e7\u00e3o, mas considerou v\u00e1lida a cobran\u00e7a dos custos para duas entidades distintas!<\/div>\n

Por\u00e9m, nem tudo ficou #FFFFFFFFFUUUUUUUU\u2026.
